1. The scope of these Terms

These Terms of Service ("Terms") govern your use of risingpeaksliving.com (the "Site"). The Site is operated by Rising Peaks Living.

The Site is a marketing site. It exists to describe Rising Peaks Living, to share information about how the home is being built, and to give referral partners and families a way to start a conversation. The Site is not an intake portal, a booking platform, an enrollment system, or a method of forming a binding agreement to provide recovery housing.

Use of the Site constitutes acceptance of these Terms. If you do not agree with these Terms, do not use the Site.

2. What the Site does and does not do

The Site does the following:

• Describes Rising Peaks Living, its operating model, the standards a Rising Peaks Living home is built around, who the model fits, and how a referral becomes a move-in once the home is open.
• Provides a contact path for referral partners, families, and prospective residents to start a conversation.

The Site does not do the following:

• It does not provide medical, clinical, treatment, or therapeutic services. Rising Peaks Living is opening as a structured co-living residence and is not a treatment facility, medical provider, or clinical service.
• It does not constitute an offer to provide recovery housing or to admit any person to a Rising Peaks Living home. Admission decisions are made through a separate intake process.
• It does not create a contractual relationship between you and Rising Peaks Living simply by virtue of your visit, your submission of the contact form, or your email correspondence with us.

3. Information on the Site is general

The Site contains information about Rising Peaks Living's operating model, locked decisions, and intended pathway. The information is current as of the date posted but is subject to change.

Information on the Site does not constitute medical, legal, financial, or housing advice. If you need professional advice, consult a qualified professional.

4. Intellectual property

The Site, including its text, layout, structure, photographs, illustrations, logos, color choices, typography choices, and code, is the intellectual property of Rising Peaks Living or its licensors. It is protected by U.S. copyright law, trademark law, and other applicable intellectual property law.

You may view, print, and download portions of the Site for personal, non-commercial reference. You may share links to pages on the Site. Any other use, including reproduction, modification, distribution, public display, or use of any Site content for commercial purposes, requires Rising Peaks Living's written permission.

The Rising Peaks Living name and the Rising Peaks Living wordmark are trademarks or trade names of Rising Peaks Living.

5. Your use of the Site

When you use the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Submit information through the contact form or by email that you know to be false, misleading, or fraudulent.
• Submit information about another person without that person's permission to the extent permission is required.
• Submit information you know to contain a virus, malicious code, or other harmful element.
• Attempt to access any part of the Site you are not authorized to access, to disrupt the Site's normal operation, or to impose an unreasonable load on the Site's infrastructure.
• Use the Site to harass, threaten, or stalk any person.
• Scrape, copy, or otherwise systematically reproduce content from the Site for any purpose other than as expressly permitted in Section 4.

We reserve the right to refuse service, to remove content, to terminate accounts (when accounts exist; the Site does not currently use accounts), and to block access to the Site, in our discretion and consistent with applicable law.

6. Content you submit

When you submit information to us through the contact form or by email, you give us the right to use that information to respond to you and to do the work you are reaching out about. We treat what you share consistent with our Privacy Policy.

You confirm that you have the right to share what you share with us. We do not claim ownership of the content you submit.

7. Third-party links and content

The Site may link to third-party websites, services, or resources. We do not control those third parties. We are not responsible for their content, their practices, or any harm that comes from your use of them. A link from the Site to a third party is not an endorsement of the third party.

8. Disclaimers

The Site is provided "as is" and "as available." To the maximum extent permitted by applicable law, Rising Peaks Living disclaims all warranties of any kind with respect to the Site.

We do not promise that the Site will be uninterrupted, error-free, secure against intrusion, or free of viruses or other harmful components. We do not promise that information on the Site is accurate, complete, or current at every moment.

Nothing on the Site is a promise of recovery housing service availability, recovery outcome, or recovery success. Recovery is difficult work that depends on many factors outside Rising Peaks Living's control, and Rising Peaks Living makes no claim about any recovery outcome for any person.

9. Limitation of liability

To the maximum extent permitted by applicable law, Rising Peaks Living and its directors, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site.

In no event will Rising Peaks Living's aggregate liability arising out of or in connection with your use of the Site exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Rising Peaks Living and its directors, officers, employees, agents, and licensors, from and against any claim, demand, damage, loss, liability, cost, or expense arising out of or in connection with your use of the Site in violation of these Terms, information you submit that is false, misleading, fraudulent, or that you did not have the right to share, or your violation of any law or third-party right.

11. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.

Any dispute arising out of or in connection with these Terms or your use of the Site that cannot be resolved through good-faith discussion will be resolved in the state or federal courts located in the City and County of Denver, Colorado.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.

13. No waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.

14. Entire agreement

These Terms, together with the Privacy Policy and any other notices posted on the Site, are the entire agreement between you and Rising Peaks Living regarding your use of the Site.

15. Changes to these Terms

We may update these Terms. When we do, we will change the "Last updated" date and, when the changes are material, will note them at the top of the Site for at least thirty days.
